1.1. These rules of purchase and sale in the e-shop shop.biodrogaspa.lt (hereinafter – the Rules) establish the mutual rights, obligations and responsibilities of the buyer – the person acquiring the goods or services, and the seller, MB Biodrogaspa.lt, when purchasing goods or services in the shop.biodrogaspa e-shop .lt (hereinafter – e-shop).
2.2. By placing an order for goods, the buyer confirms that he has read, understood and undertakes to comply with these rules.
2.3. Seller reserves the right to supplement or change these rules without prior notice. The relationship between the buyer and the seller is governed by the rules in force at the time of placing the order.
2.1. The contract of sale between the buyer and the seller is considered concluded from the moment of sending the confirmation of acceptance of the order to the buyer at the e-mail address specified by him. Upon concluding the sales contract, these rules become an integral part of the sales contract.
2.2. All contracts concluded with buyers are stored in the e-shop shop.biodrogaspa.lt
2.3. The basket of goods and services specified in the Buyer’s order, their quantity, price and other conditions become a mandatory and integral part of the contract from the sending of the confirmation of acceptance of the order to the e-mail address specified by the Buyer.
3.1. The seller has the right to change the prices of goods sold in the e-shop at any time.
3.2. Prices in the e-shop are indicated including all taxes. VAT is not excluded from the price of goods.
3.3. The price of the goods does not include the cost of delivery of the goods, they are calculated at the time of ordering and added to the final price of the order.
3.4. The price of the goods that the buyer undertakes to pay to the seller is the price indicated in the buyer’s shopping basket at the time of placing the order.
4.1. Each email the details of the goods sold in the store are generally indicated in the description of the goods accompanying each goods.
4.2. The seller is not responsible for the fact that the e-mail. the goods in the store may not correspond in color, shape or other parameters to the actual size, shape and color of the goods due to the characteristics of the monitor used by the buyer.
4.3. Each email the product / service sold in the store has a certain validity period, the specific term of which is indicated on the product packaging, gift voucher, etc.
4.4. If the goods have expired at the time of delivery to the buyer, the seller undertakes to take back such goods and replace them with similar suitable goods or return the money paid for the expired goods.
5.1. Goods of unsatisfactory quality shall be returned and replaced in accordance with the 2001 June 29 Order No. of the Minister of Economy of the Republic of Lithuania 217 “On Approval of the Rules for Return and Exchange of Items” in the current wording and Order No. of the Minister of Economy of the Republic of Lithuania No. 258 “On Approval of the Rules for the Sale of Goods and Provision of Services When Contracts Are Concluded Using Means of Communication” in the current wording.
5.2. If the Buyer does not like the shape, size, color, model or completeness of the purchased product (except hair brushes and combs), the Buyer’s request to replace the purchased product with similar products or return the money paid is not satisfied.
5.3. In order to return the defective product (s) in accordance with the rules 5.1. point, the buyer must inform the seller by e-mail. by the means of transport specified in the contact section of the store, indicating the name of the returned goods, the order number and the reasons for the return.
5.4. When returning goods of poor quality to the buyer, the following conditions must be met:
5.4.1. the returned goods must be in the original neat packaging;
5.4.2. the goods must be undamaged by the buyer;
5.4.3. the returned goods must be in the same configuration as the buyer;
5.4.4. when returning the goods, it is necessary to submit the document of its acquisition and submit a return request;
5.4.5. The buyer can return the defective product within 14 days of receipt.
5.5. The seller has the right not to accept the goods returned by the buyer if the buyer does not comply with 5.3. the return procedures laid down in Article
5.6. Upon return of the wrong product and / or defective product, the seller undertakes to accept such goods and replace them with similar suitable goods.
5.7. In case the seller does not have the goods suitable for replacement, the amount paid is refunded to the buyer, excluding the price for delivery.
6.1. The buyer is fully responsible for the accuracy of the information provided in the order and assumes responsibility for all consequences arising from the inaccuracy of the information provided by him.
6.2. The seller is liable for loss (damage) only in cases where they are caused by the intention or gross negligence of the seller or his employees.
6.3. The amount of damages to be paid by the seller is limited by the price of the item (s) ordered by the buyer.
6.4. The seller does not indemnify for indirect losses (loss of income, etc.).
6.5. The Seller shall not be liable for any malfunctions of the e-shop caused by failures of third-party systems, communication networks, stations or disruptions in the provision of third-party services used by the e-shops.
7.1. The names of goods or companies indicated in the e-shop may be trademarks, in which case the intellectual property to them is protected in accordance with the procedure established by legal acts.
7.2. The content of the e-shop website is the property of MB Biodrogaspa.lt or suppliers of
goods, protected by law. Without the written consent of MB Biodrogaspa.lt, copying or use of the website or part thereof is prohibited.
8.1. When ordering the goods in the e-shop, the buyer does not need to register, but for proper execution of the order it is necessary to provide such personal data as name, surname, e-mail, address to which the goods will be delivered, telephone number and other data specified in the order.
8.2. The Buyer confirms that he is aware of his right to refuse to provide his personal data, but understands that personal data is necessary and necessary for the execution of the order for goods, and the Buyer does not provide such data and does not consent to their processing 8.5. for the purposes specified in paragraph, the contract for the sale of goods will not be able to be concluded and performed.
8.3. By registering in the e-shop and / or placing an order for goods, the Buyer confirms that he agrees to provide his personal data specified in these Rules, the registration form and the goods order form and does not object to the seller processing such data 8.5. for the purposes set out in
8.4. The Buyer has the right to get acquainted with his personal data processed by the seller and how they are processed, demand to correct, destroy his personal data or suspend data processing actions (except storage) when the data is processed without complying with the legislation of the Republic of Lithuania.
The personal data of the buyer is collected and processed for the following purposes: to conclude a contract, to process orders for goods, to issue financial documents, to resolve issues related to the delivery and transfer of goods, to fulfill other contractual obligations. The buyer agrees that his contact details will be processed for the purpose of marketing the goods offered by the seller. The buyer has the right at any time to refuse such processing of personal data for marketing purposes.
8.6. The Seller has the right to provide the Buyer’s personal data to third parties of his choice only for the purposes specified in Clause 8.5 of the Rules. and only to the extent necessary to achieve those objectives. In no other case shall the buyer’s personal data be disclosed to third parties without the prior consent of the buyer, except in cases when the seller is obliged to do so by the legal acts of the Republic of Lithuania.
8.7. During registration in the e-shop, when filling in the order form or otherwise using the e-shop, the buyer must provide complete and correct data. If the data provided by the buyer changes, the buyer must update them immediately. The Buyer is responsible for the accuracy of the data provided in the registration form, order form or otherwise using the e-shop and assumes responsibility for the consequences arising from the erroneous or inaccurate data provided.
8.8. By registering in the e-shop and ordering goods, the buyer undertakes to keep and not disclose his login details to anyone. If the buyer loses the login details, he must immediately inform the seller. The buyer is responsible for transferring his login details to third parties. If the offers provided by the seller in the e-shop are used by a third party who has logged in with the buyer’s login details, the seller considers this person to be the buyer.
9.1. The law of the Republic of Lithuania shall apply to the relationship between the buyer and the seller arising from the purchase of goods in the e-shop.
9.2. All disagreements arising between the buyer and the seller are resolved through negotiations, and if they are not resolved – in a court in Vilnius.
9.3. All issues not discussed in these rules shall be resolved in accordance with the legal acts of the Republic of Lithuania.
Quality goods purchased online can be returned within 14 (fourteen) days from the date of delivery of the goods to the buyer.
The proof of the purchase should be presented when returning the goods.
The customer pays the return/shipping costs.
Upon receipt of the goods and assessment of their condition, the amount paid for the goods shall be refunded within 14 (fourteen) days from the date of return of the goods to the bank specified by the payer account.
